TUTORVISION – CLIENT TERMS & CONDITIONS

These Terms & Conditions (“Terms”) govern your use of the TutorVision platform and the tutoring services arranged through it. By booking, paying for, or participating in tutoring services via TutorVision, you confirm that you have read, understood, and agree to be legally bound by these Terms.

1. WHO WE ARE

1.1 TutorVision is operated by Rishi Bill and Shivam Shah, trading as a general partnership under the name TutorVision(“TutorVision”, “we”, “us”, or “our”).

1.2 TutorVision operates an online platform that connects clients with independent tutors for the delivery of tutoring services.

1.3 TutorVision does not provide tutoring or educational instruction itself and does not act as an employer, agent, or representative of any tutor.

2. NATURE OF THE SERVICES

2.1 TutorVision facilitates the arrangement of tutoring services between clients and independent tutors.

2.2 Tutors operate as independent contractors and are not employees, workers, or agents of TutorVision.

2.3 TutorVision does not supervise, direct, or control the content, delivery, or conduct of tutoring sessions.

2.4 All tutoring services are delivered at the tutor’s own professional discretion.

3. BOOKINGS, FEES AND PAYMENTS

3.1 Session prices and packages are communicated at the time of booking.

3.2 Payment is required in advance unless otherwise agreed in writing.

3.3 TutorVision may collect payments on behalf of tutors and remit fees in accordance with agreed commercial terms.

3.4 Failure to make payment may result in cancellation or suspension of services.

4. CANCELLATIONS AND REFUNDS

4.1 Sessions cancelled with at least 24 hours’ notice may be rescheduled, subject to availability.

4.2 Sessions cancelled with less than 24 hours’ notice, or missed without notice, are non-refundable.

4.3 Where a tutor cancels a session, TutorVision will use reasonable efforts to arrange a replacement session, alternative tutor, or issue a credit or refund at its discretion.

4.4 Packages are non-refundable once sessions have commenced, except where required by law.

5. TUTOR ALLOCATION AND SUBSTITUTION

5.1 TutorVision may allocate or substitute a tutor based on availability, subject needs, or operational requirements.

5.2 Any substitute tutor will be suitably qualified to provide the relevant subject support.

5.3 Tutor substitution does not automatically entitle the client to a refund.

6. ONLINE DELIVERY AND TECHNICAL REQUIREMENTS

6.1 Tutoring sessions are typically delivered online using third-party platforms.

6.2 TutorVision is not responsible for technical issues outside its reasonable control, including internet connectivity, software failures, or platform outages.

6.3 Clients are responsible for ensuring appropriate devices, internet access, and a suitable learning environment.

7. SAFEGUARDING, CONDUCT AND RISK ALLOCATION

7.1 Tutors engaged via TutorVision are solely responsible for their conduct, communications, and compliance with safeguarding, child protection, and criminal laws.

7.2 TutorVision does not supervise, monitor, or record tutoring sessions and does not assume responsibility for tutor conduct.

7.3 Tutors are responsible for obtaining and maintaining any required DBS or background checks. TutorVision makes no guarantees regarding a tutor’s background or suitability unless expressly stated.

7.4 To the fullest extent permitted by law, responsibility for any act or omission of a tutor — including (without limitation) abuse, harassment, grooming, inappropriate conduct, or criminal behaviour — rests solely with the tutor.

7.5 For students under 18, the Client is responsible for ensuring appropriate supervision and a suitable learning environment. TutorVision strongly recommends that sessions take place in shared or supervised spaces.

7.6 Any safeguarding concern or allegation must be reported to TutorVision immediately. TutorVision may suspend or remove a tutor and cooperate with relevant authorities but does not assume responsibility for the tutor’s conduct.

8. LIMITATION OF LIABILITY

8.1 To the fullest extent permitted by law, TutorVision shall not be liable for:

  • acts or omissions of tutors;

  • the content or quality of tutoring sessions;

  • academic outcomes or results;

  • indirect, consequential, or economic losses.

8.2 Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence or for fraud.

9. DATA PROTECTION

9.1 TutorVision processes personal data in accordance with the UK GDPR and the Data Protection Act 2018.

9.2 Tutors may independently process personal data for the purpose of delivering tutoring services.

10. TERMINATION

10.1 TutorVision may suspend or terminate access to services where these Terms are breached or where safeguarding or conduct concerns arise.

10.2 Termination does not affect any accrued payment obligations.

11. GOVERNING LAW

11.1 These Terms are governed by the laws of England and Wales.

11.2 The courts of England and Wales shall have exclusive jurisdiction.

12. ACCEPTANCE

By booking, paying for, or participating in tutoring services through TutorVision, you confirm that:

  • you understand TutorVision’s role as a platform connecting clients with independent tutors;

  • you acknowledge that TutorVision does not supervise or control tutoring sessions; and

  • you agree to be legally bound by these Terms & Conditions.
